CHIP IT END USER TERMS AND CONDITIONS OF SALE AND WARRANTY

1. Warranty exists for the items supplied by CHIP IT Australia Pty Ltd (hereby known as CHIP IT) only and is subject to the Conditions listed below.
2. The customer’s insurance company should be notified of any modification done to the vehicle.
3. Customers should also check the vehicle’s insurance Terms and Conditions before fitting any equipment to a vehicle to see how the item will affect their insurance.
4. CHIP IT does not take any responsibility whatsoever for any damage or injury caused through, fitting or incorrect fitting, use or misuse, installing or removing of any parts of the equipment supplied.
5. Any Kit/s, part/s sold or supplied are on the understanding that CHIP IT does not warrant the engine or drive-train unless expressly implied as per Terms and Conditions of Sale listed below and applies only on NEW Vehicles.
6. CHIP IT can provide, at an extra cost, a 3rd Party Engine Warranty for up to $5,000 engine coverage.
7. Any New Vehicle Drive Line Warranty is available only where CHIP IT parts were fitted by Authorised Installers and only when a) the stated Engine Warranty is entered into and paid for by the customer as noted on the order form, b) warranty form is confirmed by the directors of CHIP IT, c) when Warranty is taken out before customer drives the vehicle, and d) an EGT Controlled Chip is purchased.
8. No further verbal or other written warranty exist other than what is stated within this agreement.
9. All customers agree to these Terms and Conditions before fitting any part/s or kit/s supplied and agree to have the vehicle tested for safety.
10. It is a legal requirement for CHIP IT to inform its customers that this modification is for racing or off-road use only and that use on road is not allowed in some states or territories.

Returns and Guarantee Conditions Covering Performance Modules
1. The Chip It Module is covered by a Parts Warranty for 5 years and is subject to the same Terms and Conditions as prescribed under CHIP IT Returns and Guarantee Conditions General Products.
2. Harness’, plugs and connectors are specifically covered for 12 months.
3. CHIP IT provide a 30 day money back guarantee.
4. The 30 Day Money Back Guarantee applies where the Module fails to provide the performance as described by Chip It.
5. The 30 Day Money Back Guarantee does not apply whereby customers change their minds.
6. All return conditions are subject to the same Terms and Conditions as prescribed under Returns and Guarantee Conditions General Products.
7. If CHIP IT agrees to restock an Item for any other reason, a Restocking Fee of 20% will apply.
8. No CHIP IT Module will be accepted where the Module is NOT in the original packaging or in new condition.
9. No replacement item/s will be sent prior to inspection by CHIP IT of the faulty item/s.
10. Item/s will be repaired or replaced only if covered by the CHIP IT Warranty Terms & Conditions. All carriage charges to Chip It are payable by the customer.
11. No goods can be returned for credit without a Return Authorisation (RA) Number from CHIP IT.
12. Any Dead On Arrival item(s) or part(s) must be returned to our factory within 7 working days of purchase. Between 7 and 15 days a restocking fee of 20% will be deducted from the total to be returned.
13. Postage/delivery charges are Non Refundable.
14. No item(s) or part(s) will be accepted for a refund after 7 days unless it remains unused & in its original unopened packaging. Any used or damaged item/s will not be accepted. At CHIP ITs sole discretion any opened item(s) or part(s) boxes MAY be accepted for refund pending a 20-25% restocking and repackaging fee at CHIP IT’s discretion.
15. Any item missing or damaged in delivery must be claimed within 3 days of receiving the order. After 3 days no claim will be valid or accepted.
16. No item(s) or part(s) can be returned, exchanged or replaced under manufacture’s guarantee without proof of the original invoice or sales receipt.
17. Should any part of the kit fail due to poor fitting workmanship, non-standard operating conditions or environment no parts (or labour) will be guaranteed.

1. All parts are covered by the original manufacture’s 12 months guarantee & subject to the following conditions set out below.
2. This guarantee does not cover damage caused by incorrect fitting or use, accidental damage, modifications in any way or opening of unit.
3. All faulty item(s) or part(s) must be returned to CHIP IT for inspection to determine if fault is covered under the Manufacture’s Guarantee Terms & Conditions.

GUARANTEES AND WARRANTIES
YOUR PURCHASE RECEIPT MUST BE AVAILABLE BEFORE CHIP IT WILL PROSCESS ANY CLAIMS.

30 Day Money Back Guarantee Process:
Within 30 Days of Purchase, if the Chip does not provide the power increase as stated by CHIP IT, we will happily give you a Refund on the Purchase Price of the Chip (Labour & Freight costs not included).
To initiate the 30 Day Money Back Guarantee process we request you take the following steps.
1- Chip It Technical MUST be contacted on 0405 304 030 to first discuss the reason for wishing to return the Chip It Module for „Money Back‟. It maybe just technical help or a simple adjustment needed to rectify a simple problem. Sometimes a simple technical issue other than the Chip may be causing a reason for not being satisfied with the Chip. We have found that often these issues can be rectified and the customer very satisfied with the outcome.
2- If it is confirmed that the 30 Day Money Back Guarantee option is to be used, the Customer will be advised to contact the Original Place of Purchase to begin the Money Back process.
3- The Chip It System must be returned in “AS NEW” condition, including a copy of the Original Purchase Receipt, to Chip It. The Chip It System will be inspected and the Money Back process finalised. This can take up to a few weeks.
4- The Original Place of Purchase will refund the Original Purchase Price of the Chip, minus all labour costs, to the customer ONCE Chip It has authorized the refund.

5 Year Chip It System Parts/Service Warranty:
Chip It warrants the Chip It Module against tuning deficiencies (on standard engines), defects in material and poor workmanship under normal use and service for a period of „5 Years‟ from the Original Date of Purchase. Chip It, at its option, shall adjust, repair or replace the defective Chip It Module component/s.

To initiate the „5 Year Chip It Module Parts Warranty‟ process, we require these steps to be taken.
1- Chip It Technical MUST be contacted on 0400 346 129 to first discuss the problem. It maybe just technical help needed to rectify a simple problem. Sometimes a simple adjustment of the Chip It or technical issue outside the Chip It Module can cause the Chip It to appear faulty. We have found that many times these small issues can be rectified and the customer to be very satisfied with the outcome.
2- If it is confirmed that the „5 Year Chip It Module Parts/Service Warranty‟ is to be used, the Customer will be advised to return the complete Chip It Module with a copy of the Original Purchase Receipt to Chip It. The Chip It Module will be inspected tested and the component/s in question adjusted, repaired or replaced. This process can take up to a few weeks.

New Vehicle Engine and Driveline „Express Warranty‟:
Chip It offers to warrant damage caused to a engine during its New Vehicle Warranty period to a maximum of 2 years. Chip It will only support its New Vehicle Engine Warranty on legitimate claims where the Chip It Module is the „proven‟ cause of the problem and only when a Chip It Module was purchased WITH the OPTIONAL CHIP IT EGT Controller. If a manufacturer chooses not to meet their „Stated‟ or „Expressed‟ or „Government Implied‟ warranty obligations due to fitment of the Chip It Module WITH EGT Controller, then Chip It can be contacted. If the claim is legitimate and proven by Chip It, then Chip It will authorise repairs.
The Engine is „defined‟ as „the internal combustion engine” excluding any attached ancillaries which may or may not be mounted on same. This warranty is limited by the same factors and conditions which apply to the Original Vehicle Manufacturers warranty statement.

To initiate the “New Vehicle Engine and Driveline „Limited Warranty‟ process, Chip It require these steps to be taken before any claim will be considered.
1- Chip It Technical team can be contacted on 0400 346 129 to first discuss the problem. Simple technical help may be needed to rectify a problem if a misdiagnosis has occurred. Sometimes a very simple technical issue outside the Chip It installation can cause what appears to be a major issue. We have found that many times these issues can be easily rectified and have the customer totally satisfied.
2- If it is confirmed that the „New Vehicle Engine Limited Warranty‟ is to be used, Chip It at their discretion may arrange for an assessor to meet with the Vehicle Manufacturer or Dealer. The customer must obtain from the Vehicle Manufacturer a written report. This report must include images of the damaged components in question, state the details of the vehicle problem and include in the report that “the Chip It was the cause of the problem” and “how Chip It has caused the problem”. Also copy of the Original Purchase Receipt of the Chip It must be supplied.
3- If it is proven that the Chip It Module with EGT Controller (and not the installation or custom tuning of the Chip It Module) is liable for the „said‟ damage, then all repairs necessary will be authorised by Chip It.

OWNERS OBLIGATIONS
WE HIGHLY RECOMMEND,AND IN FACT ISSIST THAT THE OWNER COMPLETELY REMOVE THE CHIP IT SYSTEM BEFORE TAKING THE VEHICLE BACK DEALER FOR FAULT DIAGNOSYS, TESTING OR SERVICING!

Failing to remove the Chip It Module from the engine may lead to dealer misdiagnosis of a problem. Chip It will not be liable under this situation.
To initiate any Guarantee or Warranty offered by Chip It, a Copy of the Original Purchase Receipt MUST be made available.
The Chip It Module must be in original factory tune with no custom tuning evidenced within the Chips internal memory. If a custom tune or footprints of a custom tune or tampering of the factory tune is found within the Chip It Data Logging memory no Warranty will be offered or agreed to. Furthermore, the Chip It Module must be fitted to and tuned correctly on a totally STANDARD vehicle/engine.

If your vehicle/engine has been modified in any way, unless stated on the original purchase order form, Chip It MUST be contacted to confirm compatibility with these modifications. Some modifications may dramatically alter engine cooling air flow, induction or exhaust flow characteristics. Due to the wide variety of possible operating parameters, Chip It shall not beliable for any incidental or consequential damages. Fitment of the Chip It Module constitutes the vehicle/engine owners acceptance of these conditions.
The Chip It Module must be removed from the vehicle to return the vehicle/engine to standard operation before the Motor Dealer diagnoses the vehicle. If the Dealer finds the Chip It Module installed or evidence of the Chip It Installation no Warranty will be offered.
Attention MUST be paid to the Vehicle Manufacturer‟s Statement regarding TOWING, VEHICLE MAINTENANCE AND OPERATION, with regards to maintaining warranty coverage. Any Manufacturer‟s Statements not adhered to by the Vehicle Owner, regardless of who is at fault will void any Chip It Warranty.
In no way do these warranties cover damage to the Chip It Module due to ACCIDENT, ABUSE OR NEGLIGENCE.
We know, and you can feel confident in the fact, that the Chip It Module is engineered to be completely safe for your engine. This is why we‟re happy to provide such a comprehensive series of „Warranties‟.

A NOTE FOR THE VEHICLE MANUFACTURER
Warranty statements in owner’s manuals such as, ‘This vehicle should not be modified. Modification could affect the vehicle’s performance, safety and durability and may even violate governmental regulations. In addition, damage or performance problems resulting from modification may not be covered under the manufacturer’s vehicle warranty’ or similar are statements which are anti-competitive and run contrary to the intention of the Trade Practices Act (Cth) 1974.

Vehicle Manufacturer’s Warranty Statements are quite simply illegal at times.
‘Our View’ is that Vehicle Manufacturers refusal to allow after market modifications is ‘a unilaterally imposed contractual obligation which is restrictive and anti competitive in nature!’ It represents an attempt to coerce vehicle owners, through fear of warranty rejection, to avoid legitimate attempts to modify their vehicle to improve performance and impacts upon the livelihood of aftermarket suppliers such as Chip It Australia P/L. This is a topic that interests the ACCC Australian Anti-competition watchdog very much.
‘Our view’ is that ‘under the exclusive dealing provisions of the Trade Practices Act’, a dealer or manufacturer is not able to limit their obligations under warranty or refund provisions or make any representation that a warranty will be void if the vehicle has been modified or ‘a non genuine part’ has been installed on a vehicle.

Some Typical Examples where Technical Support from Chip It has resolved an issue
The Chip It Module is also completely removable. As you could imagine, in the event of a vehicle needing to go back to a vehicle manufacturer or dealer, if the Chip It was removed, it would also reduce the chance of a „Blame Game‟ being played by the vehicle‟s manufacturer or dealer.
Our experience over the last 20 years in the industry has shown that, at times, unprofessional methods applied by manufacturers and their dealers when warranty claims are involved. Our experience has shown in the past a tactic employed we call the „Blame Game‟. For the Dealer, economics play a SIGNIFICANT FACTOR. If the Dealer claims warranty from the Vehicle Manufacturer they typically receive $35.00 per hour and are given a set “short” period of time to perform the warranty job and are supplied parts free of charge. If the Dealer can “prove” the problem sits in YOU, the owner‟s lap, the Dealer will charge YOU between $120 – $150 per hour … and make the job a life-long project PLUS charge you full retail price for the parts. Can you now see why the dealer is keenly and activity looking to play the “BLAME GAME”?

Examples cases some have experienced:
CASE 1: „Customer A‟ went to „Dealer A‟ with his New Vehicle (which had a Chip installed on it). He went there because he had noticed a fault with the running of his New Diesel Vehicle. He left his vehicle with „Dealer A‟ for the day to have the problems fixed under warranty. A few hours later he received a phone call from „Dealer A‟ telling him that they had found the fault. „Dealer A‟ informed him it was the Chip It Module that they had found installed on his vehicle and that they were not going to go any further with repairs as they were voiding the warranty. Consequently „Customer A‟ called Chip It for help. Chip It explained to the customer that the dealer was being very unprofessional by just „wiping its hands‟ and ceasing to diagnose for the real cause of the problem after finding the Chip It installed. Chip It advised „Customer A‟ to force the dealer to unplug the Chip It Module and continue diagnosing the problem. „Customer A‟ did so, and 2 hours later called up Chip It with the outcome. The outcome was that „Dealer A” unplugged the Chip It, as requested, and found the problem still existing in the vehicle. Further investigation by „Dealer A”, now the Chip It was unplugged, uncovered a faulty „suction control valve‟ which they admitted being a common problem to that vehicle type. This problem was rectified by the dealer under warranty.

CASE 2: „Customer B‟ has an engine failure in his vehicle due to overheating and has the vehicle taken to „Dealer B‟. „Dealer B‟ inspects the vehicle and notifies the customer that the vehicle has indeed been overheated and lost all water in doing so. „Dealer B” informs the customer that the vehicle has indeed been overheated and lost all water in doing so. „Dealer B‟ informs the customer that the vehicle will not be repaired under warranty as they have found a Chip installed and that this must have caused the failure. „Customer B‟ contacts Chip It which in turn effects an Engineers report based on the information supplied. The information supplied actually points to a component failure as a result of a manufacturing fault from new. This report was submitted to the vehicles manufacturer and clearly pointed out that it was impossible for the Chip It to have caused this particular failure. The outcome was that the vehicles manufacturer covered all repairs.

CASE 3: „Customer C‟ has an engine failure in his large Boat engine. Upon inspection of the failure „Customer C‟ noted no engine oil in the engine and as a precaution to any possible warranty rejection due to a Chip It being installed, unplugged the Chip It from the engine. Upon engine removal from the boat, it was found that a failure due to corrosion in the engine oil heat exchanger had pumped all the engine oil out of the engine into the seawater causing the failure. The engine was repaired by the manufacturer under warranty.
